A group of former FBI agents who were terminated after investigating President Donald Trump filed a class action lawsuit Tuesday alleging they were fired as part of a systematic retribution campaign, raising urgent questions about the independence of federal law enforcement and the rule of law.
The lawsuit, filed in federal court in Washington, D.C., names FBI Director Kash Patel and other senior officials as defendants. It alleges that agents who participated in investigations involving the president—including the classified documents case previously overseen by Special Counsel Jack Smith—were targeted for dismissal in violation of civil service protections and whistleblower laws.
The class action structure of the lawsuit suggests the firings were not isolated incidents but rather part of a broader pattern affecting numerous agents. Legal experts say this distinction is critical, as it indicates potential systemic politicization of law enforcement rather than routine personnel decisions.
"When you see a class action, that tells you we're talking about multiple people, following a similar pattern, facing the same kind of retaliation," said Stephen Vladeck, a constitutional law professor at Georgetown University. "This isn't about one or two disgruntled employees. This is about an alleged wholesale purge of agents based on their investigative work."
According to sources familiar with the lawsuit, the terminated agents include both field investigators and supervisory personnel who worked on cases involving the president. Many had decades of experience in federal law enforcement and exemplary service records. Several had received commendations for their work on national security and counterterrorism cases.
The timing of the firings has raised eyebrows in Washington. Many dismissals came shortly after Trump returned to office and installed Patel, a longtime loyalist, as FBI director. Patel had publicly criticized the bureau's handling of Trump-related investigations and vowed to "clean house" at the agency.
