A federal judge issued an extraordinary public rebuke of the Justice Department this week, accusing prosecutors of pursuing politically motivated cases under the Trump administration—a rare instance of the judiciary openly questioning DOJ independence.
Chief Judge James Boasberg of the U.S. District Court for the District of Columbia made the pointed criticism during a hearing, according to court observers. The judge's remarks come amid growing concerns from legal scholars about the department's prosecution decisions following several high-profile cases targeting political figures and activists.
"The pattern we're seeing raises serious questions about whether prosecutorial discretion is being exercised based on the law or based on politics," one former federal prosecutor told reporters, speaking on condition of anonymity. Federal judges rarely criticize the Justice Department so directly, making Boasberg's comments particularly significant.
The judge's rebuke appears to reference multiple recent cases, including prosecutions of former Federal Reserve Chair Jerome Powell associates and investigations into media figures critical of the administration. Legal experts say such public criticism from the bench could signal broader institutional concerns about the separation of powers.
"When a federal judge goes on the record questioning DOJ motives, that's a five-alarm fire for the legal system," said Lisa Graves, a legal analyst and former Justice Department official. "Judges protect prosecutorial independence fiercely. For one to break that norm means they've seen something that deeply troubled them."
The Justice Department declined to comment on Judge Boasberg's remarks. A White House spokesman said the administration "has full confidence in the Attorney General and the department's commitment to impartial justice."
Congressional Democrats have called for oversight hearings, while some Republicans defended the administration's law enforcement priorities.
