European regulators are taking the first steps toward banning AI-generated child sexual abuse material. It's a rare case of AI regulation moving faster than the technology it's trying to control.
This is one of the few areas where there's near-universal agreement that AI needs hard limits. No one is arguing that generating synthetic CSAM should be protected speech or valuable innovation. The question isn't whether to ban it, but how to enforce the ban effectively.
The technical challenge is detection. How do you identify AI-generated CSAM versus other AI-generated content? How do you do it at scale? How do you avoid false positives that flag legitimate content?
Current detection approaches rely on known image hashes and pattern matching. Those work for redistributed material but struggle with synthetically generated content that has never been seen before. AI-generated images don't match existing hashes because they're novel creations.
Researchers are developing classifiers that can identify AI-generated images based on artifacts and patterns in how the models render certain features. But it's an arms race - every time detection improves, generation improves too. The technology that makes detection possible also makes generation better at evading detection.
The European approach appears to focus on criminalizing creation and possession regardless of detection difficulty. That's the right call. Make it clearly illegal, impose serious penalties, and force platforms to actively prevent it rather than waiting for reports.
But enforcement will be messy. Platforms will need to scan user-generated content at scale. That means building sophisticated detection systems with high accuracy rates. False positives ruin innocent users' lives. False negatives let actual abuse imagery through. Threading that needle is technically hard and ethically fraught.
The broader question is whether this represents a template for regulating other harmful AI outputs. Can the same approach work for deepfakes? For AI-generated misinformation? For synthetic identity fraud?
Probably not. CSAM is a unique case with clear harm, no legitimate use cases, and broad societal consensus. Most other AI regulation questions involve muddier tradeoffs between innovation, free speech, economic interests, and competing definitions of harm.
But it's a start. Europe is demonstrating that AI regulation is possible when there's political will. They're establishing precedent that AI-generated content can be regulated based on its harms, not given a pass because a machine made it.
