A Palestinian human rights organization has filed the first known International Criminal Court complaint against Hamas by Palestinians themselves, marking an unprecedented step in holding the militant group accountable for alleged war crimes against fellow Palestinians.
The filing, reported by the Jerusalem Post, accuses Hamas of committing war crimes including extrajudicial executions, torture, and persecution of political opponents within Gaza. The complaint represents a significant fracture in Palestinian civil society's public stance toward Hamas, which has long maintained tight control over dissent in the coastal enclave.
Legal experts familiar with the filing say it details systematic abuses by Hamas security forces against Palestinian civilians, including alleged summary executions of suspected collaborators and the torture of detainees in Gaza's prisons. The complaint also reportedly addresses Hamas's use of civilian infrastructure for military purposes during conflicts with Israel.
The ICC filing comes as the court already faces pressure over its previous investigations into both Israeli and Palestinian actions. In 2021, ICC Prosecutor Karim Khan opened a formal investigation into alleged war crimes in the Palestinian territories, examining conduct by both Israeli forces and Palestinian armed groups including Hamas.
The new complaint, however, is notable for originating from within Palestinian civil society rather than external actors. This distinction carries significant weight in international law, where victim communities bringing charges against their own authorities can bolster claims of widespread and systematic abuse.
Hamas has not yet issued an official response to the ICC filing, though the group has historically dismissed such accusations as politically motivated. The Palestinian Authority, Hamas's rival in the West Bank, has also remained publicly silent, though PA officials have long accused Hamas of human rights violations in Gaza.
In Israel, as across contested regions, security concerns and aspirations for normalcy exist in constant tension. Israeli officials have welcomed the development while noting the ICC's ongoing investigations into Israeli military actions, which rejects as biased.
