The FBI has subpoenaed X (formerly Twitter) to obtain prompts users fed to Grok, Elon Musk's AI chatbot, to create nonconsensual deepfake pornography. This case represents a significant moment in how law enforcement approaches AI-generated abuse.
According to 404 Media, the subpoena seeks detailed information about how users exploited Grok to generate explicit deepfakes of real people without their consent. This isn't about AI-generated fictional content - this is about using AI tools to create fake pornographic images of actual individuals who never consented to being sexualized.
Having worked in tech, I know exactly how these guardrails are supposed to work. Every major AI lab claims to have safety measures preventing this exact use case. The fact that Grok was used successfully for this purpose means either the safety measures failed, were insufficient, or were deliberately circumvented.
What makes this particularly interesting is the target. X under Musk has positioned itself as a free speech absolutist platform, often pushing back against moderation requests. But when the FBI comes knocking with a subpoena about AI-generated sexual abuse, there's no free speech defense. This is textbook harm.
The legal implications are significant. If the FBI can establish that X's AI tools were used to create nonconsensual intimate images, it sets precedent for holding platforms accountable for their AI systems.
